How Motor Vehicle Duty Works in Victoria

Motor vehicle duty (often called stamp duty) is a state tax collected by VicRoads on behalf of the State Revenue Office when you register or transfer ownership of a vehicle in Victoria. Under the Duties Act 2000 (Vic), the duty amount depends on three key factors:

Passenger cars, green/electric cars, motorcycles, and commercial vehicles each have different duty rates set by the SRO.

The higher of the purchase price or market value (including GST). VicRoads uses industry valuation guides to verify declared values.

Rates are set each financial year. The 2025–26 rates are unchanged from 2024–25, but always check the SRO for updates before transfer.

14-Day Rule: If you buy a used car privately, you must lodge the transfer application with VicRoads and pay stamp duty within 14 days of purchase. Late lodgement attracts penalties.

2025–26 Official Motor Vehicle Duty Rates

Rates are set under the Duties Act 2000 (Vic) and confirmed by the SRO. Rates in 2025–26 are unchanged from 2024–25. The dutiable value is always rounded up to the nearest $200 before applying the rate.

What Counts as the Dutiable Value?

The dutiable value is the higher of the purchase price or market value at the time of registration. It is critical to declare the correct value — the SRO uses industry valuation guides (like RedBook) to verify. Under-declaring can result in a reassessment notice and additional duty plus penalties.

The dutiable value includes:

  • The vehicle purchase price (including GST)
  • Luxury Car Tax (LCT) where applicable
  • Value of accessories or modifications fitted before registration
  • Repair costs if the car was improved before registration (e.g., roadworthy repairs)

The dutiable value does NOT include:

  • VicRoads registration fees
  • Transfer fees
  • CTP / TAC insurance charges
  • Stamp duty itself

If you bought a used car privately for less than its market value (e.g., from a family member), VicRoads will assess duty based on the market value — not what you paid.

🚚 Used Car from Interstate?

If you bring a registered vehicle into Victoria from another state, you still pay Victorian motor vehicle duty when you transfer or re-register it in VIC.

🎁 Gift / Inheritance

Receiving a car as a gift or inheritance? You still owe duty on the market value within 14 days. Narrow exemptions exist for spouse/partner transfers — check with SRO.

Concessions & Exemptions

In rare cases, exemptions or reduced rates apply. These are not automatic — you must apply through VicRoads or the SRO.

Disability Exemption

Vehicles modified for a person with a physical disability may be exempt from duty on the modification value or partially exempt. Applies under s.218 of the Duties Act 2000.

Frequently Asked Questions

What is the difference between stamp duty and motor vehicle duty?

They are the same thing. "Stamp duty" is the colloquial name Victorians commonly use. Officially, the State Revenue Office and the Duties Act 2000 call it motor vehicle duty. It's a state tax payable when you register or transfer a vehicle in Victoria.

Who pays stamp duty — the buyer or the seller?

The buyer/new owner is responsible for paying motor vehicle duty. VicRoads collects it when you lodge the transfer or registration application.

Is stamp duty included in drive-away pricing?

Yes, when a licensed motor car trader (LMCT) advertises a drive-away price, it must legally include all on-road costs — registration, CTP insurance, and stamp duty. However, the duty is calculated on the dutiable value (not the full drive-away price), which you must calculate separately using the SRO drive-away deal formula before the standard calculator applies.

Can I pay stamp duty in instalments?

No. Motor vehicle duty must be paid in full upfront at the time of registration or transfer — it cannot be paid in instalments. It is separate from VicRoads registration fees, which can sometimes be paid over 3, 6 or 12 months.

What happens if I under-declare the value of my car?

VicRoads and the SRO use motor industry valuation guides (such as RedBook) to check declared values. If your declared value is too low, the SRO may issue a reassessment notice requiring you to pay the additional duty. Penalties and interest may also apply.

Does a Tesla or other EV get a cheaper stamp duty rate?

Yes — pure electric vehicles and plug-in hybrids with combined CO₂ emissions of 120g/km or less qualify as "green passenger cars." They pay a flat rate of $8.40 per $200, regardless of the vehicle's price. This means a $100,000+ EV avoids the 7% and 9% luxury rates that a petrol car of the same price would attract.

Are there any stamp duty exemptions for first-home buyers of cars?

No. Unlike property stamp duty, there is no first-time vehicle buyer exemption in Victoria. The duty is based solely on vehicle type and value.

Do I pay stamp duty when buying from a dealer vs. privately?

Yes, stamp duty applies in both cases. The key difference is timing and process — dealers typically handle the registration paperwork. In a private sale, you are personally responsible for lodging the transfer and paying duty to VicRoads within 14 days of the sale date.
